Aims

  • To consider some areas of substantive Union law, as distinct from the constitutional and institutional dimension considered in LAW313.

  • To critically examine the development of EU law relating to the free movement of goods, free movement of workers and free movement of economically inactive citizens (such as students and of retired persons).

  • To explore and show appreciation of the doctrinal and policy problems as relevant to the three topics (above) under consideration.

    Learning Outcomes

    Understand how Union law is enforced in substantive areas.

    Apply provisions of the Treaty on the Functioning of the European Union and EU secondary legislation to substantive issues.

    Understand Opinions of Advocates General and judgments of the Court of Justice and critically assess their contribution to the development of EU law.

    Solve problems in these areas and discuss the process of European integration.

    Appreciate similarities and differences between EU free movement law as it applies to goods, on the one hand, and persons, on the other hand.

    Teaching and Learning Strategies

    Lecture - The lectures are designed to introduce you to the core content of the syllabus. They will cover the key areas of law relevant to the substantive topics and highlight the legal issues that will be examined further in your seminars and through your independent studies.

    Seminar - The seminars (4 x 1.5 hours) complement the lectures by providing the opportunity to explore key issues in greater detail and to apply the law to hypothetical scenarios. Seminars will also include a focus on developing key legal and transferable skills. You will be required to prepare key reading and discursive questions in advance. Working in small groups you will be asked to apply your knowledge to unseen tasks designed to test your knowledge and cultivate key legal skills (such as problem solving and negotiation).

    Tutorial - Drop-In Sessions -
    In addition to lectures and seminars, you will have the opportunity to attend a series of four one-hour "drop-in sessions". These sessions will enable you to discuss any queries or problems you are having related to any aspect of the course, as well as focusing on enhancing your key skills.

    Unseen Written Exam  135 minutes  Semester 2  100  Yes  Standard UoL penalty applies  Assessment 1 Notes (applying to all assessments) This module is assessed by a two hours and 15 minutes unseen examination. You will be required to answer one problem question (from a choice of two) and one essay question (from a choice of two). To help you prepare, you will have lectures on revision strategies and exam technique towards the end of the semester. You will have access to past exam papers throughout the module. In addition, you will undertake three formative assessments during the semester and receive feedback on each. These will take the form of online, multiple choice questionnaires. You will complete one per topic. The unseen examination is 2 hours and 15 minutes long. This includes a period of 15 minutes for reading time as per the Law School policy.
