Aims

- To ensure a solid knowledge and understanding of the main legal principles and issues in English Contract law in its social, economic and political context.
- To develop analytical, critical and research skills and to demonstrate the ability to apply knowledge to questions, reasoning and forming balanced judgments.
- To develop skills to work as part of a team including communication and negotiation skills
- To develop skills as an independent learner including time management.

Syllabus

 

Semester 1:
Lectures:
Introductions to contract – the importance of contract law, sources etc.  
Formation of a contract: offer, acceptance, intention, capacity and consideration/promissory estoppel  
Parties to the contract – the privity rule and exceptions  
Content of the contract – conditions, warranties, innominate terms, implied terms, excluding liability  
Examination skills and practice

Semester 2:
Lectures:
Vitiating factors: misrepresentation and mistake  
Formative assessment: mock examination question and feedback
Ending the contract: discharge by performance, agreement, breach and frustration  
Remedies for breach of contract: damages and specific performance


Teaching and Learning Strategies

Teaching Method 1 - Lecture
Description:

Notes: The core content of the syllabus will be covered over 48 hours of lectures. This will track the life of a contract from formation elements through negotiation, formation, content, control of unfair terms, discharge and remedies.

Teaching Method 2 - Tutorial
Description:
Attendance Recorded: Yes
Notes: Students will be required to answer set questions having undertaken research on focused areas covered in the lecture sessions. These sessions are designed to also build skills: such as analysis, application, study-skills, research and how to approach questions.
