Aims

To consider some areas of substantive Union law.

To examine the development of EU law relating to the free movement of goods (fiscal and non-fiscal restrictions), free movement of workers, and free movement of economically inactive citizens (such as students and retired persons).

To explore and understand doctrinal and policy problems as relevant to the topics (above) under consideration.


Learning Outcomes

(LO1) Understand how Union law is enforced in substantive areas.

(LO2) Apply provisions of the Treaty on the Functioning of the European Union and EU secondary legislation to substantive issues.

(LO3) Understand Opinions of Advocates General and judgments of the Court of Justice and critically assess their contribution to the development of EU law.

(LO4) Solve problems in these areas and discuss the process of European integration.

(LO5) Appreciate similarities and differences between EU free movement law as it applies to goods, on the one hand, and persons, on the other hand.

Syllabus

 

Introduction to the internal market;
The free movement of goods (fiscal);
The free movement of goods (non-fiscal)
The free movement of workers;
Citizenship of the Union and the free movement of economically inactive citizens;
Revision / advice on exam preparation and technique.


Teaching and Learning Strategies

Teaching Method 1 – Lecture

Description: The lectures are designed to introduce you to the core content of the syllabus. They will introduce you to the key areas of law relevant to the substantive topics and highlight the legal issues that will be examined further in your seminars and through your independent studies.

Teaching Method 2 – Seminar

Description: The seminars complement the lectures by providing the opportunity to explore key issues in greater detail and to apply the law to hypothetical scenarios. Seminars will also include a focus on developing key legal and transferable skills. You will be required to prepare key reading and discursive questions in advance. Working in small groups, you will also be asked to apply your knowledge to unseen tasks designed to test your knowledge and cultivate key legal skills (such as problem-solving and group negotiation).
