Aims

To stimulate the academic and practical interest of students in a challenging area of law.

To encourage and develop analytical thinking, using comparative study of legal authority where relevant.

To enable the creation of effective solutions to (legally and factually) complex problems.

To develop an effective argument, soundly based in critical analysis of the law both orally and in writing.

To develop detailed knowledge of the law in all areas .

Syllabus

 

The module addresses two broad areas within commercial law, the Sale of Goods and the Law of Agency. Within these areas a number of legal issues will be considered, including fundamental concepts such as what is a sale of goods, property and title, authority and consent in Agency Law etc. The module will cover particular areas of practical and/or legal significance, such as sale distinguished from other related transactions, e.g. hire-purchase; implied terms in sale of goods contracts ; obligations of delivery and payment; passing of property and risk in goods ; sale by a non-owner; remedies of buyer and seller ; duties of agent and principal; contracts made by agents; and termination of the agency relationship.

Please note that not all the above topics may necessarily be taught in any given semester.

Teaching Method 1 - Lecture
Description: Lectures are designed to focus on certain matters within the syllabus focusing on particularly novel, interesting or complex legal issues. To facilitate your engagement with the lectures, notes on the fundamental principles of Commercial Law will be made available prior to the relevant lectures.

Teaching Method 2 - Seminar
Description: Seminars are the mid-way point of the learning and teaching pattern of Commercial Law. The seminars will, for the most part, be focused on the application of the legal framework to complex factual situations and developing higher-level skills of analysis and critique.

Teaching Method 3 - Online
Description: Online exercises will be used to structure student engagement both before and after the seminars. Online exercises include multiple choice question tests, pre and post seminar exercises and podcasts.Attendance Recorded: Not yet decided

Teaching Method 4 - Drop-In Sessions
Description: The module utilises post-seminar drop-in sessions to consolidate learning from the seminars and explore more advanced problems. The drop-in sessions have structured exercises to faciltate student reflection on their knowledge and understanding of the relevant area of law.
