Aims

To stimulate the academic interest of students in a complex and evolving area of law;
To deliver the substantive elements of the subject area in accordance with the requirements laid down by the Bar Council, governing the content of qualifying Law degree programmes;
To enhance general legal and transferable skills in the context of the subject area;
To allow students to carry out independent tasks and research to a high level of aptitude.


Learning Outcomes

(LO1) Evaluate the functions of the trust in specific socio-legal contexts and the implications this has for social justice

(LO2) Summarise the role equity has played and continues to play in the contemporary legal system

(LO3) Evaluate the practical implications for individuals of the operation of Equity & Trusts in England and Wales, e.g., with reference to the ownership of the family home.

(LO4) Analyse complex legal statutory material, case law and academic writing.

(LO5) Appreciate the social and economic (especially fiscal) context of trusts.

(LO6) Apply theory and doctrine to contemporary legal problems.

Syllabus

 

An indicative syllabus may include:
Concepts of Property, Foundation of Equity, the Trust & Remedies;

Express trusts in context, for e.g., secret trusts, non-charitable purpose trusts
Resulting trusts
Secret Trusts
Implied Trusts in Context: Family Homes;
Charitable Purpose trusts;
Trustees’ Powers and Duties;
Administration of Trusts;
Strangers liability;
Breach of Trust, Tracing.


Teaching and Learning Strategies

Learning and teaching on this module will be structured in accordance with synchronous lectures and seminar sessions. Lectures run for 2 hours a week for the 11 week cycle . Seminars run for 90 mins at equal intervals across the 12 week term.

•Seminars - 8 x 90 mins sessions across the terms (4 per semester)
•Lectures- 22 x 2hr sessions, 1 per week across each term (11per semester)
• Workshops – 4 hrs across the terms (2 hrs per semester)

Each of the below is the topic of a 90 min seminar and 2-6 hours synchronous lecture content.
