Aims

Background Non Communicable Diseases (NCDs) account for nearly 86% of deaths and 77% of the disease burden in Europe. These alarming rates have given rise to a growing awareness of the need for the European Union and its Member States to promote healthier lifestyles in tackling the four main risk factors for NCDs, namely tobacco, the harmful use of alcohol, unhealthy diets and physical inactivity. Aims The Law and NCD Prevention in Europe course will address the role that legal instruments may play in preventing NCDs. It will focus on EU and national laws and policies and their relationship, whilst replacing them within a broader, international framework. This module, which is the first of its kind in Europe, will provide a thorough and critical grounding in the fundamental legal principles and policy concerns underpinning the development of NCD prevention strategies in Europe. It is also intended to build capacity in global public health law and therefore bridge the gap between the ory and practice in an area where specialised lawyers are still very few and far between though in greater demand than ever. It will make extensive use of case studies.


Learning Outcomes

(LO1) Generic programme outcomes and skills: Demonstrate principles and techniques of advanced legal research Show an understanding of the relevant social, economic, political, historical, philosophical, ethical, scientific and cultural contexts within which regulatory instruments can be used to promote healthier lifestyles and prevent NCDs in Europe and beyond Demonstrate that the chosen taught modules have been studied in depth Identify, locate and retrieve source legal materials in Law and NCD Prevention in Europe, both in paper and electronic form Analyse, evaluate and interpret the principal source materials of Law and NCD Prevention in Europe, including national statutes, national, European and international law reports, treaties, directives and other relevant materials as appropriate Apply legal knowledge to a practical situation and draw reasoned conclusions supported by legal authority Synthesise information from primary legal sources to achieve detailed knowledge and under standing of how regulatory instruments can be used to promote healthier lifestyles and prevent NCDs Understand and employ relevant legal terminology, both orally and in writing, to explain and convey technical legal information at an advanced level Demonstrate advanced legal skills (e.g. critical analysis) necessary to enable students to reach a superior understanding of Law and NCD Prevention in Europe Develop critical analysis skills Utilise problem-solving skills in complex theoretical and practical contexts Develop time management and prioritisation skills by working to deadlines Develop individual and group communication skills by seminar presentations Develop oral discussion skills by participating in debates and problem-solving exercises Take responsibility for their own learning Develop their skills in reading, analysing and synthesising different viewpoints and presenting their findings/conclusions in clear, comprehensible, structured format, with detailed argumentation where appropriate Be able to make a critical judgment of the merits of particular arguments and make a reasoned choice between alternative solutions or arguments  Subject specific outcomes:  At the end of the module, students should be able to: demonstrate thorough knowledge of the legal principles underpinning the developing policies at EU and national level on NCD prevention; demonstrating thorough understanding of the relationship between EU law and national law on NCD prevention; demonstrate critical awareness of the broader constitutional, policy, ethical and cultural implications of using legal instruments to prevent NCDs and promote healthier lifestyles; locate and handle appropriate legal and non-legal materials; carry out research on Law and NCD Prevention in Europe; draw analogies and comparisons between different sectors of EU intervention on lifestyle risks (tobacco, alcohol-related harm, unhealthy diets, lack of physical activity); engage in comparative research, asses sing the extent to which experiments in different countries could be used elsewhere.
