Aims

To introduce the constitutional and institutional law of the European Union;

To develop an understanding of EU legislative procedures; the nature and limits of Union competence; and the system of judicial review governing Union acts;

To explore the application of EU law within national legal systems;

To encourage you to think critically about the integration process, e.g., the democratic character of EU decision-making processes and the effectiveness of the system of judicial protection against Union acts.

Syllabus

 

Outline syllabus:

Institutional Architecture of the EU:historical development and basic structure of the European Union from thefounding EEC Treaty to present; composition and functions of main Union institutions; inter-institutional balance in the adoption of legislative measures, and in their implementation;

Union Competences: general scheme of Union competences; general principles of Union law (especially respect for human rights and fundamental freedoms); annulment of Union acts via Article 263 TFEU and Article 267 TFEU;

EU Law in the National Legal Systems:direct effect; supremacy; effective judicial protection (especially the Francovich right to reparation); preliminary references from national courts to the Court of Justice of the European Union.

Teaching Method 1 - Lecture

Notes: The core syllabus will be covered in 22 hours of lectures, divided into three distinct parts. These lectures will introduce you to the key principles and contemporary debates in the areas of constitutional and institutional EU law examined on this module. The remaining 2 hours of lectures will be used to provide you with additional feedback on your formative assessment (1 hour, wk 9) and to focus on coursework skills (1 hour, wk 12).

Notes: There are 4 seminars cycles (90 mins each on this module). Seminars on this module offer students the invaluable opportunity to consolidate their learning from lectures and independent study, and to build essential skills, such as problem solving, essay writing and the communication and analysis of contemporary debates. Seminars will correspond to the topics covered in lectures, whilst also bringing issues together so that students are able to understand the EU as a complex legal order. Seminars will contain a series of both seen and unseen tasks, assigned to students working together in small groups.
